GENERAL TERMS AND CONDITIONS OF CONTRACTING

1 - PURPOSE
Through these terms, the specific regulation governing the purchase of products through the website portal www.outlet-pool.com is established, without prejudice to the parties being able, by mutual agreement, to establish different conditions before the order is formalized.
Acceptance of this document electronically has the same contractual validity as an in-person signature. Following all the steps described in the contracting procedure electronically implies the presumption that the user unequivocally accepts these general terms and conditions of contracting. We reserve the right to modify these terms at any time, as well as any other document displayed on the website, with the contracting terms published at the time of contracting being applicable. These modifications will not, under any circumstances, have retroactive effect.
The entire contracting process will be carried out in Spanish and we will store a copy of the contract accepted by the user, and in any case it will be sent together with the confirmation email.
2 - PURCHASE PROCEDURE
The contracting procedure through the online platform is carried out completely electronically, for which only a series of steps indicated below must be followed.
Any person with Internet access can carry out the contracting, with the only prior requirement of having registered as a user and, in all cases, having legal capacity and capacity to act, according to current legislation, to sign private contracts. This requirement is essential in order to start the contracting procedure and for the resulting contract to be valid. If the user is not yet registered, they must complete a form with a series of personal data considered essential to carry out the management, billing, and shipping of the orders finally placed.
Throughout the procedure it is possible to view the different stages of contracting. However, so that the user may have prior access to this information, those stages are indicated below:
2.1 - Shopping cart
Stage in which the product is added to the electronic shopping cart available on the website. All products included in the cart may be removed, whenever the user indicates so.
Despite adding a specific product, the user may continue shopping, with all selected products remaining in the cart until they click the button to continue the contracting procedure.
Registered users may receive purchase suggestions for products similar to those previously purchased. In addition, users who started a shopping cart and did not complete the order may receive commercial communications reminding them that they can complete their purchase.
2.2 - User identification
Stage in which the user must enter their user data (username and password, if already registered), or register as a new user (providing first name, last name, email address, and password), or access as a guest. In all cases it will be necessary to provide a series of data and, when registering as a new user, expressly accept the Privacy Policy and these Conditions.
2.3 - Shipping information
Stage in which the user must indicate whether they want shipping to be made to the address indicated in their registration, or to a different one.
2.4 - Selection of Shipping Method
vStage in which the user must indicate the shipping method they wish to contract. If only one shipping method is available, a situation that may arise for shipments to certain geographic locations, the user must only press the continue button.
2.5 - Selection of payment method and acceptance of the contracting conditions
Stage in which the user must indicate the method with which they wish to make the payment and proceed to pay the total amount of the order.
The available payment methods are the following:
1) Through the financial institution PayPal.
2) By TPV credit card.
3) Through installment payment via the financial institution SeQura.
4) Cash on Delivery - Buy now and pay in 7 days, also through the financial institution SeQura.
5) By bank transfer.
Payments Through Paypal:
To pay the corresponding amounts through PayPal, you may choose to identify yourself as a registered PayPal user, for which it will be necessary to include your PayPal username and password, or choose to pay as a PayPal guest, for which you will only need to include your credit card details and click pay.
Payments by credit card:
The payment procedure by credit card is completely private between the buyer and the corresponding bank, so at no time will we have access to your card details. When selecting this payment method and confirming the purchase, you will be redirected to Banco Sabadell's payment platform where the corresponding payment will be made. For more information regarding communication of your data to Banco Sabadell, the user can access the Privacy Policy.
In all cases, payment of amounts through the Internet will be carried out through the platform provided by the financial institution, which will at all times be hosted on a website under secure SSL protocol. For your identification, confirm that the web address of the page from which you are going to make the payment begins with https://.
SeQura installment payment:
OUTLET POOL, in collaboration with SeQura, offers deferred payment for orders, with the possibility of choosing payment over three, six, and twelve months, with the sole charge of a fixed surcharge for each installment established according to the amount of the order. For more information, refer to SeQura payment instructions. This payment method is limited to a minimum amount of €100 and a maximum amount of €2708; if payment is selected for a higher amount, you will be required, when placing the order, to pay the amount that exceeds that maximum amount and installment payment will be processed for the remaining amount. SeQura reserves the right to accept or reject any order if it does not meet its minimum risk criteria.
Cash on Delivery Payment - Buy now and pay in 7 days:
OUTLET POOL, in collaboration with SeQura, offers the payment method 'Buy now and pay in 7 days' in which the customer may have up to 7 days from the dispatch of the order from OUTLET POOL to pay the amount thereof. After placing the order, you will be redirected to the SeQura platform where the financial institution will require the customer to provide the relevant information to authorize the order. Once authorized by the financial institution, the order will be shipped; 7 days after shipment of the order, the customer will receive an email with instructions and deadline for payment. For more information, refer to SeQura payment instructions. This payment method is limited to a maximum order amount of €1000. SeQura may reject an order if it does not meet its minimum risk criteria.
Bank Transfer:
If the selected payment method is bank transfer, the product shipment will not be made until we receive the full economic amount in our account. This payment method is not immediate, and receipt of funds may be delayed up to 72 hours from the time of issuance. Orders to be paid by bank transfer will be held for up to 15 days after the order is placed. If the corresponding transfer is not received after that period, a new order must be placed.
Once the bank transfer option has been selected, before being able to make the corresponding payment, it will be necessary for the user to expressly accept the contracting conditions, and it will not be possible to continue with the contracting procedure if they have not been previously accepted. Once the conditions are accepted and the purchase confirmed, the user will receive an email at the address provided during the purchase process, containing the order quote. The quote will contain the itemized price of the products and the bank account to which payment for the products must be made. In addition, through the link available in the email to make payment, you may access the Redsys Virtual TPV operated by Banco Sabadell, where you can make immediate payment by credit card.
As explained in the section “Payments by credit card,” the payment procedure is completely private between the buyer and the bank, so at no time will we have access to your card details. For more information regarding communication of your data to Banco Sabadell, the user can access the Privacy Policy.
2.6 Responsibilities based on the selected payment method
In cases where the User selects payments through bank card, via Paypal, SeQura, or through other virtual payment platforms (TPV), their personal banking data will be processed by a third party. We inform you that OUTLET POOL does not have access at any time to the payment data provided, which are digitized directly in the payment gateway and are securely processed by the payment service provider, whom you may contact to exercise your rights, under the terms established in their privacy policies.
2.7 - Order confirmation
Once payment is made, the system will automatically display a screen with the order confirmation, indicating the products purchased, total price thereof, taxes included, as well as billing and shipping data.
Immediately afterwards and within a maximum period of 24 hours, the buyer will receive an email showing all information related to their purchase. This document is confirmation that the purchase was completed successfully and serves as proof for any type of claim, provided that proof of the corresponding payment is attached. If you do not receive this email, check your “junk mail” or “antispam” account, as it may have been detected as spam. If you do not find it in that section, please notify us as soon as possible so we can solve the problem.
The provider informs the user that purchases made will be recorded in a Customer file for control and management of orders, monitoring payment status and shipment and receipt of products. As a means of controlling orders placed, you can access the list of all your orders through the “my account” section where, after identification, you may see the order number, date, amount, payment method, as well as its status.
2.8 – Proposal of personalized offers by the user
In order to facilitate the purchase procedure for users, as well as achieve more competitive prices, we make available to you the option of making specific offers for marketed products.
Through the “make your offer” button you can communicate with us and propose a specific economic offer such as contracting several units or any other circumstance that could improve the quote initially shown on the online platform. This offer made completely unilaterally will in all cases be non-binding for OUTLET POOL, so we do not commit to expressing ourselves regarding it, either positively or negatively.
Under no circumstances do we commit to guaranteeing the user the making of a counteroffer regarding their initially proposed offer. Not having expressed anything in this regard does not imply that the offer has been tacitly accepted; in all cases there must be an express acceptance regulated by signing the corresponding contract.
3 - PRICE, PAYMENT and BILLING
The acquisition of any of the products marketed through our online platform requires payment of the amounts indicated next to each of them.
The prices indicated for each product are fully valid.
All prices on the web platform are indicated in euros and include VAT, duly itemized in the purchase summary and in the invoice, which you may request, both in paper and electronic format, via the contact email info@outlet-pool.com and it is also available in the private area in PDF format. Value Added Tax will only be applicable to users residing in member states of the European Union, except those excluded areas
The price of the marketed products does not include, unless otherwise specifically provided, their installation. If you require installation services, do not hesitate to contact our customer service department so that we can inform you regarding the conditions.
Custom-made or personalized products have an additional cost derived from their adaptation to what is required by the buyer.
3.1 - Discount coupon code
We may launch discount coupon codes, always with a specific duration period, and in all cases subject to the timing or availability conditions indicated in each offer.
To validate coupon codes, they must be entered in the “order review” section, once the purchase process has started. If the code is no longer valid, you will be informed before making payment.
Users may only validate one code per purchase.
4 - PURCHASE SHIPPING
OUTLET POOL makes available to you a set of transport means suitable for the specific characteristics of the marketed products.
4.1 – Time of shipment
Shipment of acquired products will be carried out according to the method selected by the user among those provided or, where appropriate, those available at the time the purchase is made.
In all cases, the product will be sent in the manner indicated in the purchase summary sent to the user. Shipment of acquired products will only be made when the user has made full payment and it has been received by the provider. Until that moment, the purchase will not be deemed completed.
The period for order processing and management is between 24 and 72 hours from the moment payment for the product is received or financing is approved by the financial institution. In any case, once the order has been shipped, we will send you an email from the online platform to the address you provided.
4.2 – Delivery times
Delivery times are indicated in the description of each product. In general terms, delivery will be made within 2 to 10 business days after execution of the order. In the case of custom-made or personalized products, delivery time will be extended to 60 business days.
If we cannot meet the initially agreed delivery times (maximum of 10 or 60 days, as explained in the previous paragraph), we will contact the buyer to inform them of the situation and offer alternative products we have in stock or proceed with a full refund of the amount.
If the product is out of stock at suppliers, manufacturers, and importers, we will inform the customer of the situation so that they can decide whether they wish to cancel the order and request a refund of the amount paid, without the 14-day limit expressly provided for by current regulations for exercising the right of withdrawal being applicable to this type of case.
There is a possibility that the selected product is not in stock. In these cases we have to request the product from the official distributor, so delivery to the customer may be delayed up to 20 days from when the provider received payment. However, the provider will inform the user in advance of this circumstance.
Despite having products in stock, this may be insufficient in case of high demand. In such case, existing products will be delivered according to order sequence, informing users who did not receive their order of the incident, so that they can decide whether they wish to cancel the order and request a refund of the amount paid, without the 14-day limit expressly provided for by current regulations for exercising the right of withdrawal being applicable to this type of case. Such communication may be made by phone or email.
For shipment to be carried out correctly and on time, it is essential that you provide us with a valid contact phone number during the purchase process. If you do not do so, or if it is incorrect, delays not attributable to OUTLET POOL may result, from which no liability will arise on its part.
4.3 – Shipping costs
Shipping costs will be paid, unless otherwise specifically provided, by the buyer, being paid together with the total economic amount derived from the products included in the order.
The shipping costs indicated during the purchase process will only be valid for mainland Spain. If shipping must be made to the Balearic Islands, Canary Islands, Ceuta, Melilla, or any country other than Spain, please consult our sales agents to obtain a personalized quote.
In the case of shipping to non-EU countries, customs duties will be excluded from shipping costs and will be borne by the customer. Likewise, in the case of shipping to the Canary Islands, IGIC and customs clearance costs will be excluded and will also be borne by the customer.

4.4 – Receipt of merchandise
The purchased products will be delivered to the exact address provided at the time of purchase through the online platform. The transport agency is only responsible for delivering your order to the entrance of your home building.
Delivery will be carried out by a specialized transport agency, in order to guarantee greater speed, security, and quality in the logistics of shipping our products.
All deliveries will be made by the carrier of the selected transport agency, and in all cases there will be a delivery note in which, after verifying the contents and before signing the corresponding delivery note, it is recommended to indicate on it any type of anomaly that the order may present. Reject any order not accompanied by the corresponding delivery note.
In any case, if errors, faults, or damage to the merchandise are not detected until after opening, it is recommended to notify OUTLET POOL within 48 hours, in order to begin product replacement procedures as quickly as possible.
However, if you would like more information regarding shipping cost methods, price, delivery times, and the specific characteristics of each of them, we recommend that you consult our customer service.
5 - WARRANTIES AND RIGHT OF WITHDRAWAL
5.1 - Warranties
All products offered are original brand products, with factory warranty certificate and without any defect. All have a 3-year warranty, which starts from the moment of delivery.
If the product is not in conformity with what was contracted, the buyer must notify OUTLET POOL and will have the right to choose between correction of that lack of conformity, price reduction, or termination of the contract. For correction, the buyer will have the right to choose between repair or replacement, unless one of these two options is impossible or, compared with the other corrective measure, entails disproportionate costs for the trader, taking into account all circumstances.
If the necessary repair or replacement is not covered by the warranty under the established terms, the customer must bear the costs, both for diagnosis, repair, and shipping.
5.2 - Right of withdrawal
The right of withdrawal from a contract is the right you have to cancel the concluded contract, notifying us of such intention within the period established for exercising this right, without needing to justify your decision and without penalty of any kind.
The withdrawal period will expire 14 calendar days from the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the goods. To exercise the right of withdrawal, you must notify us at the address indicated above of your decision to withdraw from the contract through an unequivocal declaration by e-mail or postal mail. You may use the model withdrawal form set out below, although its use is not mandatory.
To exercise the right of withdrawal, the user only has to select one of these three options:
1) Contact us by telephone at 93 522 01 05, our agents will provide you with every facility to carry out this procedure.
2) Complete the request we provide through the following form to request it in writing at the postal address indicated above.
3) Or through the following electronic contact form.
To meet the withdrawal deadline, it is sufficient that communication concerning your exercise of this right is sent before the corresponding period expires.
Consequences of withdrawal:
In case of withdrawal on your part, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method different from the least expensive ordinary delivery method that we offer) without undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.
We will make such reimbursement using the same payment method used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any costs as a result of the reimbursement.
We may withhold reimbursement until we have received the goods, or until you have provided proof of return of the same, whichever condition is met first.
You must return or deliver the goods directly to us or to the address shown above, without undue delay and, in any case, no later than within 14 calendar days from the date on which you communicate your decision to withdraw from the contract, directly assuming the return cost. The deadline will be deemed met if you return the goods before said period has concluded, and you must assume the direct cost of returning the goods. If we have not received the goods or proof of return within the indicated period, it will be understood that you waive exercising the right of withdrawal.
When, by their nature, the products cannot normally be returned by post, you must assume the direct cost of returning the goods.
You will only be responsible for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exercising the right of withdrawal requires at all times that the user sends the provider the product as it was received, without using it beyond merely checking its good condition and nature. The product must be sent in its original packaging, in such a way that deterioration during transport is not possible, with the user assuming possible damage during transport and resulting liabilities. If it is not returned with the same original packaging, the item may suffer depreciation. The provider will not accept return of the product when it shows obvious signs of use or deterioration. Likewise, the provider may never accept returns of material that has been unsealed, used and/or put in contact with water.
Likewise and in accordance with article 45 of Royal Legislative Decree 1/2007, it will not be possible to exercise the right of withdrawal in cases where products made according to consumer specifications or clearly personalized are purchased, or that, by their nature, cannot be returned or may deteriorate or expire rapidly.
The right of withdrawal will not apply to contracts referring to:
1) The provision of services, once the service has already been fully performed, when performance has begun with prior express consent of the consumer and user and with their acknowledgment that they are aware that, once the contract has been fully performed by the trader, they will have lost their right of withdrawal.
2) The supply of goods or provision of services whose price depends on financial market fluctuations that the trader cannot control and which may occur during the withdrawal period.
3) The supply of goods made according to the specifications of the consumer and user or clearly personalized.
4) The supply of goods that may deteriorate or expire rapidly.
5) The supply of sealed goods not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery.
The supply of digital content not provided on a tangible medium when performance has begun with the prior express consent of the consumer and user, with their knowledge that consequently they lose their right of withdrawal.
5.3 - Product replacement
If the contracted good or service is not available, when the consumer and user has been expressly informed of such possibility, we will make available to the user, at no price increase, a good or service with similar characteristics and with the same or superior quality.
In this case, the consumer and user may exercise their rights of withdrawal and termination under the same terms as if it were the initially requested good or service.
5.4 - Responsibilities
The provider undertakes that the contents, data, or information regarding the products or services offered on its website are reliable, truthful, and accurate, being responsible for the prices and characteristics announced. However, it will not be responsible for information introduced, displayed, or modified by third parties unrelated to the provider.
If purchasing products that must be integrated with other elements or parts, we ask that you verify beforehand that the marketed model is perfectly compatible with the other device or part. Except for the exercise of the right of withdrawal, we are not in any way responsible for inconveniences that such situation may cause. The provider focuses solely on the sale of products offered through the website. All offered products have their corresponding official 3-year manufacturer warranty, as well as expressly established return periods.
We are not responsible for non-performance of the contract in cases of force majeure, conflicts, strikes, fires, floods. In case of stock break or temporary unavailability of the product, we will contact the buyer to inform them of the situation and offer alternative products we have in stock or proceed with a full refund of the amount.
6 - USE OF CHAT
The user agrees to use the services offered through the chat in good faith, diligently, and appropriately, at all times complying with what is stipulated in these general terms and conditions of contracting.
Access by minors is prohibited, with users, or where appropriate their corresponding legal guardians, being responsible for any direct or indirect damage that may be caused as a consequence of non-compliance with such obligation.
From OUTLET POOL, we are not responsible for the truthfulness of the data provided by users, so each user will be solely responsible for possible consequences that may derive from the inaccuracy of the data.
We do not guarantee availability and continuity of chatbot operation and are not responsible for damages, of any nature, that may be due to lack of availability or continuity and, in particular, also not for failures in access or services provided through it.
In addition, we reserve the right to prohibit access to the chat at any time to all users who fail to comply with the obligations stipulated in these general terms and conditions of contracting.
All personal data collected during use of the Chat will be processed in accordance with the Privacy Policy, which every user must accept in order to use it.
7 - CUSTOMER SERVICE
OUTLET POOL makes available to users a complete customer service, both by telephone and through the chat itself that we have integrated into our online platform. In any case, both before and after placing an order, the user may contact us through any of these means.
In any case, we reserve the right to record conversations made through telephone and chat in order to guarantee user security, as well as better provision of customer service. Whenever we do so, we will request prior consent from the end user, in accordance with the Privacy Policy and Organic Law 3/2018 on Protection of Personal Data and Guarantee of Digital Rights. In accordance with current regulations, we inform you that calls to 902 are considered interprovincial calls, not included in the usual flat rates of telecommunications operators. The price of each call will depend on the operator from which you make the call. Check the price before making said call.
8 - SAFEGUARD CLAUSE
All clauses or points of this contract must be interpreted independently and autonomously, with the rest of the provisions not being affected if one of them has been declared NULL by final court judgment. The contracting parties agree to replace the affected clause or clauses with another or others that preserve the effects pursued by the parties.
9 - DATA PROTECTION
OUTLET POOL complies with the new European Union General Data Protection Regulation EU 2016/679. In compliance with article 14 of European Regulation 679/2016 on data protection, we inform you that the personal data obtained are incorporated into data processing for which OUTLET POOL is responsible. For more information on the processing of your data, you may consult the Privacy Policy section on our website.
10 - INTELLECTUAL AND INDUSTRIAL PROPERTY
These General Terms and Conditions of Contracting do not imply the transfer of any type of exploitation right over any intellectual creation whose rights belong to us. You may not exploit any of said rights for any purpose, unless we expressly and in writing assign to you the necessary exploitation rights to do so.
11 - NON-COMMERCIAL NATURE
These General Terms and Conditions of Contracting are understood to be made with you, in your capacity as a consumer, as provided in Royal Legislative Decree 1/2007. In this regard, you declare that the contracting is carried out to use, privately, and where appropriate for leisure purposes, the products and services offered. In this regard, you undertake not to carry out any contracting aimed at obtaining economic returns or for commercial purposes.
12 - WAIVER
Our omission in requiring you to comply with the obligations established in these General Terms and Conditions of Contracting on one or more occasions may not be considered a waiver of the corresponding right, nor will it deprive us of the power to require strict compliance with those obligations thereafter.
13 - ASSIGNMENT
You accept that you may not assign, in favor of a third party, the rights and obligations set out in these General Terms and Conditions of Contracting without our prior and express authorization.
14 - INFORMATION ABOUT THE DISPOSAL OF WASTE FROM ELECTRONIC DEVICES (WEEE)
It is not permitted to dispose of electrical and electronic devices ("EEE") in household waste containers or in any other that is not specifically intended for this purpose, nor in public roads. Batteries and accumulators that are not fixed to EEE must be separated from them. The User may deliver the batteries, after use and at their choice, at specific collection points. Waste from EEE ("WEEE") must be accompanied by the following symbols to indicate compliance with Directive 2012/19/EU, Royal Decree 110/2015, and other applicable regulations ("WEEE Regulations") regarding Waste from Electrical and Electronic Equipment ("WEEE"), including identification of harmful substances, specifically "Cd" for Cadmium, "Hg" for Mercury, and "Pb" for Lead:
Consequently, with the purchase of a Product that has the condition of EEE, in accordance with the foregoing, the User may deliver to the Seller an equivalent type of WEEE (under the terms set out in the applicable regulations) at the delivery point of the EEE or at the User's home where supply of the EEE takes place. If the User requires collection of WEEE at home, they must request it through customer service, preferably through the email address info@outlet-pool.com.
If delivery of WEEE is not made at the User's home, the User will have a period of thirty (30) calendar days to deposit the WEEE at a point in the Seller's sales network, and on the day of WEEE delivery, within said period, must present the simplified invoice proving purchase of the acquired EEE.
The User must package the EEE securely for transport, using for this a stable package that prevents movement of interior elements, and if necessary filling the package with cushioning elements (for example newspapers). The User must ensure that in shipment of EEE, extractable batteries and accumulators are separated, as well as removing corresponding personal data.
The provisions of this section are made without prejudice to the User's right to freely and at no cost deposit WEEE at collection points specifically established by Local Entities and EEE Manufacturers in accordance with current regulations.
15 - SPECIFIC OBLIGATIONS RELATING TO THE DISTRIBUTION, MARKETING, AND OWNERSHIP OF FLUIDS AND EQUIPMENT BASED ON THEM
Regulation (EU) 517/2014 of the European Parliament and of the Council of April 16, 2014, Law 34/2007 of November 15 on air quality and protection of the atmosphere, and in particular Royal Decree 115/2017 of February 17, which regulates the marketing and handling of fluorinated gases and equipment based on them, as well as certification of professionals who use them and which establishes technical requirements for facilities carrying out activities that emit fluorinated gases, are applicable. In this regard, it is stated that Outlet Pool complies with the specific obligation established in article 9.8 of said Royal Decree, relating to the distribution, marketing, and ownership of fluids and equipment based on them.

These General Terms and Conditions of Contracting are applicable from the moment the user accesses the website, and will remain in force at all times.
